Sec. 9.01. DEFINITIONS. In this chapter:
(1) [amended 9/1/97] "Custody" has the meaning assigned by Section 38.01.
(2) [amended 9/1/97] "Escape" has the meaning assigned by Section 38.01.
(3) "Deadly force" means force that is intended or known by the actor to cause, or in the manner of its use or intended use is capable of causing, death or serious bodily injury.
Before 9/1/97 (1) and (2) provided:
(1) "Custody" means:
(A) under arrest by a peace officer; or
(B) under restraint by a public servant pursuant to an order of a court.
(2) "Escape" means unauthorized departure from custody or failure to return to custody following temporary leave for a specific purpose or limited period, but does not include a violation of conditions of community supervision or parole, or following leave that is part of an intermittent sentence.
